These Terms of Service (“Terms”) govern your access to and use of the services provided by Advurtix (“we,” “our,” or “us”). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services. These Terms constitute a legally binding agreement between you and Advurtix.

2. Description of Service

Advurtix provides premium advertising account management services, including access to agency ad accounts across major advertising platforms such as Meta, Google, TikTok, Snapchat, Newsbreak, and Bigo. Our services include account provisioning, compliance support, campaign management tools, and related consulting services.

3. User Accounts

Account Creation

To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and complete.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any advertising platform's terms of service or policies
• Submit fraudulent, misleading, or deceptive advertising content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our services
• Use our services to distribute malware, spam, or harmful content
• Resell, sublicense, or redistribute our services without written consent

5. Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may temporarily suspend or limit access to our services for maintenance, updates, or security purposes. We will make reasonable efforts to notify you of planned outages in advance.

6. Payment Terms

Fees and Billing

You agree to pay all fees associated with the services you use. Fees are billed in accordance with the pricing plan you select. All fees are stated in US dollars unless otherwise specified. We reserve the right to modify our pricing with 30 days' notice.

Late Payments

If payment is not received by the due date, we may suspend your access to our services until payment is received. We may also charge a late fee of 1.5% per month on any outstanding balance. You are responsible for all costs of collection, including reasonable attorney's fees.

7. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, trademarks, software, and design, are the exclusive property of Advurtix or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the data practices described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Advurtix and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of our services, regardless of the theory of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Advurtix and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of our services, your violation of these Terms, or your violation of any rights of another party.

11. Termination

Termination by You

You may terminate your account at any time by contacting us. Upon termination, your right to use our services will immediately cease. Any outstanding fees remain due and payable.

Termination by Us

We may terminate or suspend your access to our services immediately, without prior notice or liability, if you breach these Terms. We may also terminate your account for any reason with 30 days' written notice. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the relevant arbitration body in the jurisdiction specified in the Governing Law section below.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Advurtix is established, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
